Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the Delivery Scout iOS app and the deliveryscout.app website (together, the "Service"), provided by NG Digital Holdings LLC ("we", "us"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Your use of the App is also subject to Apple's App Store Terms of Service.

2. Description of the service

Delivery Scout is an informational tool for gig delivery drivers. It helps you score delivery offers and estimate figures such as dollars per hour, dollars per mile, and net earnings after estimated costs, and it lets you keep your own records of shifts and mileage. The Service uses information you provide or that is visible on your own device.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service.

4. Advisory only — you make every decision

Delivery Scout is advisory. Its scores, verdicts, and estimates are suggestions based on the information available; they are not instructions or guarantees. The app does not accept, decline, automate, or interact with any delivery platform, and it cannot act on your behalf. Every decision to accept or decline an offer is made by you, inside the delivery platform's own app. You are solely responsible for your driving decisions and your compliance with each platform's terms.

5. No guaranteed earnings

We do not promise or guarantee any level of earnings, offers, or results. Estimates depend on inputs that can be incomplete or inaccurate, and real-world outcomes vary. Nothing in the Service is a promise of income.

6. No tax, legal, or financial advice

Mileage records, expense estimates, and any tax-related figures are informational only and are provided for your convenience. They are not tax, legal, accounting, or financial advice, and they are not a substitute for a qualified professional. You are responsible for the accuracy of your own records and filings.

7. Your responsibilities

• Use the Service safely and lawfully, and never interact with the app while driving in a way that is unsafe or illegal.
• Verify offer details yourself before acting on them.
• Follow the terms of the delivery platforms you work with.
• Keep your device and any backups secure, since your app data lives on your device.

8. Independence from delivery platforms

Delivery Scout is an independent product. It is not affiliated with, endorsed by, sponsored by, or connected to DoorDash, Uber Eats, Grubhub, Instacart, Walmart Spark, or any other delivery platform. All platform names and marks belong to their respective owners and are used only to describe compatibility.

9. Subscriptions and purchases

The Service may offer optional paid features through subscriptions or one-time purchases. All purchases are processed by Apple through the App Store and StoreKit, and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel a subscription in your Apple account settings. Except where required by law or by Apple's policies, payments are non-refundable; refund requests are handled by Apple.

Founder Lifetime purchase

A "Founder Lifetime" purchase, where offered, is a one-time purchase that grants access to the Delivery Scout Pro features available in the iOS app for as long as the app remains available and operable on your device and supported platform, subject to these Terms. It applies to the current in-app Pro feature set and does not entitle you to unrelated future products or external services, and it does not guarantee indefinite availability of the app or any specific feature. It is governed by Apple's purchase terms like any other App Store purchase.

10. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code except as permitted by law;
• Interfere with or disrupt the Service or attempt to bypass purchase or security controls;
• Use the Service to violate any law or any delivery platform's terms;
• Resell, sublicense, or commercially redistribute the Service without our written permission.

11. Intellectual property

The Service, including its software, design, text, and logo, is owned by NG Digital Holdings LLC and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. These Terms do not transfer any ownership to you. Data you create with the app is yours.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, and non-infringement. We do not warrant that scores, parses, estimates, or mileage figures will be accurate, complete, or uninterrupted. You use the Service at your own risk.

13. Limitation of liability

To the fullest extent permitted by law, NG Digital Holdings LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost earnings, or lost data, arising from or related to your use of the Service. To the extent liability cannot be excluded, our total liability for any claim is limited to the amount you paid for the Service in the twelve months before the claim, or USD $50, whichever is greater.

14. Termination

You may stop using the Service at any time by deleting the app. We may suspend or end the Service, or your access to it, if you violate these Terms or if we discontinue the product. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and intellectual property) will continue to apply.

15. Changes to these terms

We may update these Terms as the Service evolves. When we do, we'll change the "Last updated" date above and post the revised Terms here. Your continued use of the Service after changes take effect means you accept the revised Terms.
